南海领土争端之国际法问题

【摘要】中国自古就对南海诸岛享有无可争议的主权。但是近年来，中国与南海周边国家就南海诸岛问题的争执与摩擦愈演愈烈；同时，某些域外国家，像美国、日本、印度等国家纷纷插足到南海争端中，这更加加剧了南海问题的复杂性，使得各国之间的博弈更加艰难。南海区域错综复杂的安全形势不仅严重损害了我国在南海的国家利益；而且涉及到我国如何合理处理和争端各国的国际关系的外交问题。南海问题包括多层次的问题：国家主权、能源资源、航运自由权、地区影响力等，更为关键的是南海问题的涉事国比较多，不仅有东盟诸国，而且包括美国等世界大国，这些因素加剧了南海争端呈现出多边化、国际化和大国政治化的趋势。现阶段中国的国家发展和周边安全环境迫切要求我们必须妥善有效地应对南海诸岛争端。特别是随着中国的和平崛起进程不断加速，都决定了中国必须在维护南海通道安全上担起更大的责任，做一个负责任的大国。因此，通过积极稳妥的方式推进解决南海诸岛争端问题是中国当前刻不容缓的重大任务。

【Abstract】TheSouthChinaSeaislandshavebeenChineseterritorysinceancienttimes.Inrecentyears,ChinaandtheSouthChinaSeasurroundingcountriesonthedisputebetweentheSouthChinaSeaislandsintensified;theUnitedStates,Japan,IndiaandothercountrieshavesetfootintheSouthChinaSeaislanddispute,makingtheSouthChinaSearegionmorecomplicatedsecuritysituation.TheuncertaintyoftheregionalsecuritysituationintheSouthChinaSeaandtheSouthChinaSeanotonlyconfrontsoursecurityinterestsandnationalinterestsintheSouthChinaSea,butalsoinvolvesthediplomaticdimensionofhowChina'sinternationalrelationswiththedisputingcountriesdealwithit.AstheSouthChinaSeaissueinvolvesnationalsovereignty,resources,shipping,regionalinfluenceandmanyotheraspectsoftheproblem,involvingtheinternationalsubjectandtheinfluencingfactorsaremore,therefore,addingthecomplexityofthedisputeovertheSouthChinaSeaislands,theSouthChinaSeadisputeproblemsMultilateralization,internationalizationandthetrendofpoliticization.ProperlyandeffectivelydealwiththedisputeovertheSouthChinaSeaislands,themaintenanceofthesecurityoftheSouthChinaSeaislandsforChina'ssovereignmaintenanceandnationalinterests,thesignificanceisparticularlyimportant.Especiallyw
