Introduction:
Theexclusionofillegalevidenceisacrucialaspectofanyfairandjustcriminaljusticesystem.Inrecentyears,significantamendmentshavebeenmadetotheCriminalProcedureLawinordertoenhancetheprotectionofindividualrightsandensuretheintegrityofthecriminaljusticeprocess.ThispaperaimstoprovideacomprehensiveanalysisoftheapplicationoftheexclusionaryrulebyprosecutorialauthoritiesinChina,withafocusontherecentamendmentstotheCriminalProcedureLaw.
1.Theimportanceoftheexclusionaryrule:
Theexclusionaryruleservesasasafeguardagainsttheviolationofconstitutionalrightsandprinciplesoffairnessincriminalinvestigationsandtrials.Itpreventstheuseofevidenceobtainedthroughillegalmeans,suchascoercedconfessionsorsearchesconductedwithoutproperauthorization.Byexcludingsuchevidence,theruleaimstodetermisconductbylawenforcementofficersandmaintaintheintegrityofthecriminaljusticesystem.
2.TheapplicationoftheexclusionaryruleinChina:
Previously,theChinesecriminaljusticesystemhadalimitedapplicationoftheexclusionaryrule,leadingtoconcernsaboutviolationsofdefendants'rights.TherevisedCriminalProcedureLaw,effectivesince2013,introducedseveralsignificantchangestoenhancetheapplicationoftheexclusionaryruleinChina.ThisincludesprovisionssuchasArticle56,whichexpresslyprohibitstheuseofevidenceobtainedthroughtorture,andArticle55,whichallowsthedefensetochallengethelegalityofevidenceandrequestitsexclusion.
3.Thechallengesinapplyingtheexclusionaryrule:
DespitetheamendmentstotheCriminalProcedureLaw,thereareseveralchallengesineffectivelyapplyingtheexclusionaryruleinChina.Thesechallengesincludethelackofawarenessandtrainingamonglawenforcementofficers,theneedforbettermechanismstoenforcetheexclusionaryrule,andthepotentialforjudgestobelenientinexcludingillegallyobtainedevidence.
