Introduction:
TheoutbreakoftheCOVID-19pandemichashadaprofoundimpactonallsectorsoftheglobaleconomy,includingcivilaviation.Tocontrolthespreadofthevirus,governmentsandinternationalorganizationshaveimplementednumerousmeasuresaffectingairtravel,suchastravelbans,quarantinerequirements,andflightsuspensions.ThispaperaimstoanalyzetheinternationallegalbasisforcivilaviationregulatorymeasuresimplementedinresponsetotheCOVID-19pandemic.
I.InternationalHealthRegulations:
TheprimarylegalinstrumentguidingtheresponsetopublichealthemergenciesistheInternationalHealthRegulations(IHR)establishedbytheWorldHealthOrganization(WHO).TheIHRprovideaframeworkforassessing,respondingto,andcoordinatingnationalandinternationalhealthmeasuresrelatingtotheinternationalspreadofdiseases.StateshavealegalobligationtonotifytheWHOofanypublichealtheventswithintheirterritorythatconstituteapotentialinternationalthreat.Inthecontextofcivilaviation,theIHRauthorizestatestoimplementmeasures,suchashealthscreeningsandquarantinerequirements,toprotectpublichealth.
II.InternationalCivilAviationOrganization(ICAO):
TheICAO,aspecializedagencyoftheUnitedNations,isresponsiblefordevelopingandregulatinginternationalaviationstandardsandpractices.TheorganizationhasrespondedtotheCOVID-19pandemicbyissuingguidelinesandrecommendationstoaddressoperationalchallengesfacedbytheaviationindustry.Memberstatesareencouragedtofollowtheseguidelines,especiallythosepertainingtopassengerhealthscreening,aircraftdisinfection,andcrewprotection.WhiletheICAOdoesnotpossesslegallybindingauthority,itsrecommendationscarrysignificantweight,asnon-compliancecouldresultinadverseconsequences,suchaslimitedaccesstointernationalairroutes.
III.BilateralandMultilateralAgreements:
