ThispaperbeginswithashorthistoryoftraderemedylawsinMexico,followedbya
briefsummaryofthemajordifferenceswiththeUnitedStatesandCanadianantidumping
andcountervailingdutylawsandanaccountofMexicanuseofsuchlawssince1986.It
thenfocusesontheapplicationoftheForeignTradeLaw(FTL)(revisedthrough2006)1
andtheimplementingregulations(FTLRegulations)(2000).2Thepaperconcludeswitha
discussionofadministrativeandjudicialreview;NAFTAChapter19reviewisdiscussed
elsewhere.WhilewearewellawarethatundertheMexicanlegalsystemdecisionallaw
isnotcontrolling,wehaveneverthelessdrawnonthedecisionsofMexicancourts,the
WTODisputeSettlementBodyandNAFTAChapter19binationalpanels,aswellas
finaldeterminationsbytheinvestigatingauthorityasanaidtounderstandinghowthe
FTLandFTLRegulationshavebeenappliedinpractice.

1HistoricalDevelopment

1.1AccessiontoGATT

UnliketheUnitedStatesandCanada,Mexicodoesnothavealonghistoryofthe
implementationofantidumpingandcountervailingdutylaws.Rather,theenactmentof
theselawscoincidedwithMexico’saccessiontoGATTin1986.Priorto1986,Mexico’s
wasprimarilyaclosedeconomy.Hightariffsandtheextensiveuseofimportquotas
protectedhigh-cost,inefficientlocalindustry;therewasnoneedforantidumpingor
countervailingdutylawstoprovideadditionalprotection.3AsCraigGieszehasobserved,
