内容摘要市场上大受欢迎，但因为自身透明度低和政府背景的原因，也受到东道国保护目前国内关于主权财富基金的法学研究相对较少，本文的写作目的和创新之处析各国国内层面和国际层面的法律规制和相关立法动态，对我国的实践提出建全文包括前言、正文和结语三部分，其中正文共有四章：题，明确界定主权财富基金的法律地位，反驳保护主义的无理指责。的立法成果和趋势，及其对主权财富基金产生的影响。关键词：主权财富基金；法律地位；国际经济新秩序在次债危机的背景下，主权财富基金(SovereignWealthFunds)在国际金融主义的指责。保护主义主张加大对主权财富基金的投资审查和金融监管力度。我国外汇储备丰富，成立主权财富基金对我国有重要的现实意义和战略意义。是试图从法学的角度对主权财富基金这一现象进行梳理，在此基础上系统地分议，并反思主权财富基金的兴起对建立国际经济新秩序的意义。第一章，重点介绍主权财富基金的概念及发展趋势，分析主权财富基金的兴起的意义和引发的争论。第二章，通过讨论主权财富基金的法律形式及主权财富基金的国家豁免问第三章，分析现存的国内层面和国际双边及多边层面上关于主权财富基金第四章，在前一章的基础之上，对我国完善国内相关法律法规，规范主权财富基金的管理和运作，以及参与主权财富基金国际立法活动提出建议。
