Introduction
Intheworldoflaw,thereexistsarangeoflegalsystemsandframeworks.Eachoneofthesesystemsdiffersbothintheirformandapplication.Oneofthemostimportantlegalsystemsthatexistintheworldisthelawofproperty.Theimportanceofpropertylawarisesfromthefactthatitgovernstherelationshipbetweenpeopleandthephysicalworld.Itis,therefore,anintegralpartofoureverydaylives,beitinourhomes,ourbusinesses,orthelandweoccupy.Propertylawgovernslegalrightstoresourcesinasociety,includingland,water,andotherresources.ThegoalofthispaperistoinvestigatethedifferencesbetweentheEnglishversionofpropertylawandthePhysicalversionofthislawattunedtotheChinesecontext.
LegalFramework
TheEnglishframeworkforpropertylawisfoundedoncommonlawandisdefinedbyanumberofprinciples,includingtherighttotransferthepropertytoanewowner,therighttoenjoytheproperty,andtherighttohavethepropertyprotectedfromanythreatsfromoutsideforces.Thecommon-lawapproachtopropertylawinEnglandisrootedinhistoryandishighlydiversified.
Ontheotherhand,Chinahasasetofregulationsandstatutesthatprovidealegalfoundationfortherightsandinterestsofpropertyowners.TheregulationofpropertylawinChinaisframedbylegalprinciplessuchastheprotectionofprivateproperty,thepromotionofsocialjustice,andtheprotectionofnaturalresources.
PropertyRights
Theownershiprightsofthepropertyarefundamentalinpropertylaw.Aspropertyistheprimarysourceofownership,itisimportantthatthelegalsystemoffersarobustframeworkregardingpropertyrights.TheEnglishlawofpropertyprovidespropertyownerswithawiderangeofrights.Forexample,Englishpropertylawofferstherighttotheexclusivepossessionofland,therighttotransferownership,therighttoenjoyment,therighttousethepropertyascollateral,therighttoreceivecompensationiftheirpropertyistakenawaybythegovernment,andtherighttoobtainanequitablecompensationifathirdpartyinterfereswiththeirrights.
