Introduction
Section337oftheTariffActof1930(19U.S.C.§1337)isapowerfultoolforintellectualpropertyrightsholderstoprotecttheirrightsintheUnitedStates.ItauthorizestheUnitedStatesInternationalTradeCommission(ITC)toinvestigateandissueexclusionordersagainstimportsthatinfringecertainintellectualpropertyrights,includingpatents,trademarks,andcopyrights.Inthispaper,wewillstudySection337indetail,includingitsobjectives,procedures,andimpact.
ObjectivesofSection337
TheprimaryobjectiveofSection337istoprotectdomesticindustries,particularlythoseofstrategicimportance,fromunfaircompetitionbyimportedgoods.Section337allowsadomesticindustrytoobtainreliefifitcanshowthatimportedgoodsinfringeitsintellectualpropertyrightsandthattheinfringementharmsitsdomesticindustry.Thisharmcanarisefromavarietyoffactors,suchaslostsales,priceerosion,reducedprofits,anddamagetoreputation.
AnotherimportantobjectiveofSection337istopromotetheenforcementofintellectualpropertyrightsintheUnitedStates.BygivingtheITCtheauthoritytoissueexclusionordersagainstinfringingimports,Section337createsapowerfuldeterrentagainstforeigncompaniesthatmightotherwisebetemptedtoinfringeU.S.intellectualpropertyrightswithimpunity.This,inturn,helpstoleveltheplayingfieldfordomesticbusinessesthatrelyonintellectualpropertytocompete.
ProceduresofSection337
TheproceduresofSection337arecomplexandinvolvemultiplestages.Theprocessbeginswiththefilingofacomplaintbyadomesticindustrythatallegesthatithassufferedharmduetotheimportationofinfringinggoods.ThecomplaintmustbefiledwiththeITC,whichwilltheninitiateaninvestigation.IftheITCdeterminesthatthereisaviolationofSection337,itmayissueanexclusionorderthatprohibitstheimportationofinfringinggoods.
Theinvestigationprocessitselfisoftenlengthyandinvolvesthegatheringofevidence,thesubmissionofbriefs,andtheholdingofhearings.TheITCtypicallyhas16to18monthstocompleteaninvestigation,althoughthistimelinecanbeextendedincertaincircumstances.Attheconclusionoftheinvestigation,theITCwillissueadeterminationthatei
