Introduction:
Constructionsitesaredangerousplaces,andaccidentsarecommon.TheUKlegalframeworksetsouttheresponsibilitiesofbuildingcontractorswithregardtosafetyonconstructionsitesandtheliabilityofpartiesresponsibleforaccidentsthatmayoccurduringtheconstructionprocess.Inthispaper,IwilldiscussthelegalframeworkintheUKrelatingtopersonalinjuryclaimsintheconstructionindustrywithaspecificfocusontheliabilityofbuildingcontractors.
LegalFramework:
ThereareseveralkeypiecesoflegislationintheUKthatsetoutthelegalframeworkforpersonalinjuryclaimsintheconstructionindustry.TheseincludetheHealthandSafetyatWorketc.Act1974,TheConstruction(DesignandManagement)Regulations2015,andTheWorkatHeightRegulations2005.
TheHealthandSafetyatWorkAct1974placesadutyonemployerstoprovideasafeandhealthyworkingenvironmentfortheiremployeesandtoensurethatthosewhomaybeaffectedbytheiractivities,suchasthepublic,arenotexposedtoriskstotheirhealthandsafety.Thisincludestakingmeasurestopreventaccidentsonconstructionsites.
TheConstruction(DesignandManagement)Regulations2015placeresponsibilitiesonthoseinvolvedinconstructionprojects,includingbuildingcontractors,toensurethattheyplan,manage,andexecutetheirconstructionworkssafelyonaconstructionsite.Theymustensurethatriskstothesafetyandhealthofworkersandmembersofthepublicareeliminatedorreducedsofarasreasonablypracticable.Thisincludesadequatecooperationandcommunicationbetweencontractorsinvolvedinworkattheconstructionsite,andensuringsufficientcoordinationoftheworkstoensurethatthesafetyofallismaintained.
TheWorkatHeightRegulations2005setsoutrequirementsforcontrollingtherisksofworkingatheight.Thisincludesusingappropriatemeasurestopreventfallsfromheightandensuringthatworkatheightisproperlyplannedandsupervised.
LiabilityofBuildingContractors:
Buildingcontractorshaveadutyofcaretowardsthosewhoareinvolvedinoraffectedbytheirconstructionactivities.Thisincludestheresponsibilitytotakeallreasonablestepstoensurethesafetyoftheiremployees,subcontractors,visitorstot
