Introduction
CommercialarbitrationisapopularformofdisputeresolutioninHongKong,wherepartiesagreetosettledisputesoutsideofcourtthroughanarbitrator.Inthisessay,wewillanalyzeacommercialarbitrationcasethattookplaceinHongKong.Themainobjectiveistoprovideadetailedanalysisofthecase,highlightingtheprocessfollowed,theissuesidentified,andtheoutcomeofthearbitration.
Background
Thecaseinvolvedtwoparties,CompanyAandCompanyB,whoenteredintoacontractforthesupplyofgoods.Thecontractcontainedaclausethatrequiredthepartiestosettleanydisputesthrougharbitration,governedbytheHongKongInternationalArbitrationCentre(HKIAC)rules.AdisputearosewhenCompanyAreceivedthegoodsbutdidnotfindthemtobeoftherightquality,asagreeduponinthecontract.CompanyAdemandedcompensationfromCompanyB,butthelatterrefused,statingthatthegoodswereoftherightquality.
TheProcess
Asperthearbitrationclauseinthecontract,thepartiesagreedtosettletheirdisputethrougharbitration.TheyappointedanarbitratorwhowasapprovedbytheHKIAC.Thearbitrator,afterstudyingthecase,setahearingdatewherebothpartiescouldpresenttheirargumentsandevidence.Priortothehearing,thepartiessubmittedwrittenbriefsoutliningtheircaseandsupportingevidence.
Duringthehearing,bothpartiespresentedtheirargumentsandevidencetothearbitrator,whomadeanawardafterconsideringalltherelevantfactsandlegalprovisions.Theawardwasfinalandbinding,andthepartieswererequiredtoabidebyit.
Issues
ThemainissueinthecasewaswhetherthegoodssuppliedbyCompanyBwereoftherightqualityasagreeduponinthecontract.CompanyAarguedthatthegoodswerenotuptostandardandwantedcompensation.CompanyB,ontheotherhand,arguedthatthegoodswereoftherightquality,andnocompensationwasdue.
Inresolvingtheissue,thearbitratorhadtoconsidertheevidencesubmittedbybothpartiesregardingthequalityofthegoods.Thearbitratoralsohadtoconsidertherelevantlegalprovisions,includingthetermsofthecontract,theSaleofGoodsOrdinance(Cap.26),andtheHKIACrules.
