论文题目：对我国民事诉讼简易程序的思考

摘要
通过诉讼程序有利于定纷止争，充分保障诉讼当事人的利益，而我国诉讼中设立的简易程序是在我国多年的司法实践中创建的快捷、高效地解决争议的一种诉讼法律程序。我国的诉讼程序中的诉讼简易程序能够更加快捷和高效地解决社会纠纷，其在维护社会稳定中，充分保障诉讼当事人充分行使诉讼权利，依法保障人民法院依法审理案件中，都具有十分积极的作用，但是在我国的以往的司法实践中，诉讼简易程序又暴露出其许多问题。简易程序存在的问题主要有：立法不完备,制度不健全,过于粗简；简易程序的适用范围过于狭窄；运行过于繁琐,各方面不简易，没有实质性的简化措施；简易程序和普通程序界限不清。所以完善简易程序可以从以下几个方面来考虑：完善简易程序的立法，建立独立的体系；明确并适度扩大简易程序的适用范围；简化简易程序的具体运作方式；完善简易程序与普通程序转换机制，设置专门的机构和人员。

Abstract
ThroughcivilproceedingsinfavorofMediatingdispute,tofullyprotecttheinterestsofthepartiesincivillitigation,andthesummaryofCivilProcedureisestablishedquicklycreatedinourcountryformanyyearsofpracticeinciviljusticeandefficientsettlementofdisputesisnotcivildisputesAcivilactionproceedings.Ourcivilproceedingsinthecivilactionsummarycanbemorequicklyandefficientlyresolvesocialdisputes,whichinsafeguardingsocialstability,tofullyprotectthefullexerciseofcivillitigantlitigationrightsaccordingtothelawtoprotectpeople'sCourtcivilcasesinaccordancewiththelaw,haveaverypositiverole,butinourpreviousjudicialpractice,civillitigationandsummarilyexposeditsmanyproblems.SummaryThemainproblemsare:thelegislationisnotperfect,thesystemisnotperfect,tooroughsimple;thescopeofapplicationofsummaryprocedurewastoonarrow;runningtoocumbersome,noteasyinallaspects,norealsimplification;simplifiedproceduresandcommonprocedureslimitunclear.Soperfectsummarycanbeconsideredfromthefollowingaspects:improvingthelegislativesummary,theestablishmentofanindependentsystem;clearandmoderateexpansionofthescopeofapplicationofsummaryprocedure;asimplifiedsummaryofthespecificmodeofoperation;simplifiedproceduresandcommonprocedurestoimproveconversionmechanism,setupspecialinstitutionsandpersonnel.
