摘要
随着住宅商品化及物业管理的发展，业主委员会作为维护业主合法权益，参与物业管理的制度得到了普及和推广。随着业主与房地产开发商及物业管理企业之间纠纷的上升，业主委员会代表全体业主作为一方当事人参与诉讼的案件随之上升，业主委员会是否具有诉讼主体资格，既能否以自己的名义起诉及应诉，以及业主委员会诉讼主体资格是否应受到限制，既业主委员会除了充任原告之外，是否可以充任被告，以及业主委员会起诉是否必须限定在物业管理纠纷范围之内等问题，引起了理论界及司法实践的高度关注。对于这些问题，目前在理论界及实务操作中尚有争议。
本文通过介绍关于业主委员会是否具有诉讼主体资格以及其诉讼主体资格是否应受到限制的各种理论观点，各地方性立法关于业主委员会诉讼主体资格的不同规定，以及司法实践中各地法院在审理业主委员会作为当事人的案件的不同作法，以便使读者全面了解业主委员会诉讼主体资格问题在理论及实践中的现状。在了解业主委员会诉讼主体资格在理论及实践的现状的基础上，笔者从分析在赋予业主委员会诉讼主体资格的意义，以及世界其他国家及地区关于非法人的管理委员会及管理人具有当事人能力的立法经验可以借鉴等，来综合论述应通过统一立法赋予业主委员会诉讼主体资格。同时，笔者根据目前业主委员会的特征
以及《物业管理条例》关于业主委员会民事行为能力的限制性规定，认为目前的
业主委员会诉讼主体资格应当受到限制，最后提出了立法建议。

Abstract
Witllthedevelopmentoftheresidentialcommercializationandthepropertymanagement，theregulationofthePropertyOwnersCommittee’sparticipatinginpropertymanagementastheorganizationtosafeguardthepropertyowners’legalrightshasbeenpopularizedandpromted．Withtheincreasingdisputesamongpropertyowners，realestatedevelopersandpropertymariagemeatenterprises，thesuingcasesinwhichthePropertyOwnersCommiReeisinvolvedrepresentingtheoverallpropertyownershavebeenincreasing．TheproblemsconcemingwhetherthePropertyOwnersCommitteehasthequalificationasthesuingparty(whetheritcansueandlitigateinthenameofitsel0；whetherthequalificationofthePropertyOwnersCommittee，asthesuingsubject,shouldbelimited(whethertheProperty0wnersCommitteeearlholdboththepositionsofplaintiffanddefend,ant)；andwhetherthePropertyOwnersCommittee’ssuingshouldbelimitedwithinthedissensionscopeofpropertymanagement．AIlaboveiSSUCShavearousedhiattentioninthetheoryfieldandthejudicialpracticefield．Therearestillcontroversiesabouttheseproblemsinthetheoryfieldandpractice．
