Thelegalsystemofacountryplaysacrucialroleinfacilitatingfavorableconditionsforitsdevelopmentandprosperity.Amongalllegalforms,standardizationlawmarksthepivotallegaltoolbyprovidingaframeofreferenceforproductsandservicesqualityassuranceandtradingstandardization.Justlikemanyothercountries,Chinahasbeencarryingoutaseriesofstandardizationlawreformattemptstoimproveitslegalframework.TounderstandhowChinacouldlearnfromtheUnitedStates'standardizationpolicyandmeasuresinthepursuitofasoundstandardizationlegalframework,thispaperwilldelveintoanin-depthdiscussionofChina'sstandardizationlegalreformfromtheUS'spolicyandmeasuresperspective.
CurrentStatusofChina'sStandardizationLegalFramework
BeforeweaddressthepossiblelearningsChinacandrawfromtheUSstandardizationlegalframeworkreform,let'sfirsttakealookatChina'sexistingstandardizationlegalframework.China'slegislationconcerningstandardizationdatesbacktoasearlyas1988whenitcameupwiththeStandardizationLawthatprovidedthelegalbasisforstandardizationreformandmodernization.ThelawhasplayedacriticalroleinleadingChina'sstandardizationprocess.
Generally,China'sstandardizationsystemcomprisesnationalstandards,localstandards,industrystandards,andenterprisestandards.Thesestandardshavebeendevelopedatvaryinglevelsofadministrativeauthority,wherebyeachlevelisresponsibleforitsownlevelofstandardsdevelopment.However,despitethefoundationallegalframeworkdevelopedbytheStandardizationLawof1988,China'sstandardizationlegalsystemhasbeencriticizedforitscomplexity,low-qualitystandards,andinadequateenforcement.ThishasledtoseriousqualityissuesthathaveaffectedChina'seconomicgrowthandthewell-beingofitscitizens.
USStandardizationPolicyandMeasures
TheUnitedStatesisoneoftheworld'sleadingstandardizationnationswithawell-structuredandestablishedstandardizationlegalframework.TheAmericanNationalStandardsInstitute(ANSI)isresponsibleforoverseeingthestandarddevelopmentandmaintenanceprocess.Despitebeinganon-governmentalorganization,ANSIhasbeenaut
