古法英译话互文——以《唐律》为个案分析的中国古代法律英译研究
Introduction
Chinahasalongandrichlegalhistory,withtheearliestrecordedlawsdatingbackmorethan3,000yearsagointheZhoudynasty.Overtime,Chinahashadmanylegalcodesdeveloped,eachwithitsownuniquecharacteristicsandapproach.AmongthesecodesistheTangCode(Tanglu),issuedduringtheTangdynasty(618-907AD).ThiscodeisconsideredtobeoneofthemostsignificantlegalcodesinChinesehistory.
However,despiteitsimportance,theTangCodehasnotbeenwidelytranslatedintoEnglish.Inthispaper,wewilldiscussthechallengesoftranslatingChineselegaltexts,examinetheexistingtranslationsoftheTangCode,andproposesolutionsforimprovingthequalityofthesetranslations.
ChallengesofTranslatingChineseLegalTexts
TranslatingChineselegaltextsposesseveralchallenges.OnesignificantchallengeisthelackofdirectequivalentsforlegaltermsinEnglish.Thetwolanguageshavedifferentlegalsystems,andsothesameconceptmaynotexistinbothlanguages.ThismakesitdifficulttoconveytheexactmeaningoftheChineselegaltextinEnglish.
AnothersignificantchallengeistheuseofarchaiclanguageinChineselegaltexts.Manyofthesetextswerewrittenoverathousandyearsago,andthelanguagetheyuseisoftennolongerincurrentusage.ThismakesitdifficultforatranslatorwhoisnotfluentinclassicalChinesetounderstandthetextfully.
Finally,thestructure,style,andformatofChineselegaltextsaredifferentfromthoseofEnglishlegaltexts.Chineselegaltextsarewritteninamorenarrativestyle,andtheyoftenincludebackgroundinformationandanecdotes.Thiscanmakeitdifficulttoconveythetext'smeaning.
ExistingTranslationsoftheTangCode
ThereareseveralexistingtranslationsoftheTangCode,includingthosebyW.G.OldandJ.R.Ware.Additionally,severalonlinesourcesoffertranslationsoftheTangCode,butthequalityofthesetranslationsisinconsistent.Someofthesetranslationsappeartohavebeenmadeusingmachinetranslationsoftware,whichmeanstheymaycontainsignificanterrorsandinaccuracies.
