国际贸易中电子合同法律问题探讨
【摘要】随着科技的迅猛发展，互联网已经渗透到大众生活的方方面面，而电子商务的出现则是跟上了时代步伐的表现。而随着电子商务的迅速扩张，传统合同已经不能满足当前国际贸易中的需求，电子合同也应运而生，这是贸易繁荣发展的产物，但同时伴随而来的许多关于电子合同的纠纷以及出现的法律问题。
本文较为系统地研究电子合同在国际贸易会涉及到相关法律问题以及其订立后是否有效进行分析，从而了解导致国际贸易电子合同容易产生风险的因素，为企业在签订电子商贸合同的时提供理论指导以及规避潜在风险的建议，让企业在外贸实践中正确有效地应用这一合同形式，为企业提供吸引贸易伙伴、保障自身利益的一条可行之路。从而增强企业的国际竞争力，加速国家贸易的发展。

[Abstract]Withtherapiddevelopmentoftechnology,theInternethaspenetratedintoallaspectsofpubliclife,andtheemergenceofe-commerceisaperformancethatkeepspacewiththetimes.Withtherapidexpansionofe-commerce,traditionalcontractscannolongermeettheneedsofcurrentinternationaltrade,andelectroniccontractshavealsoemerged.Thisisaproductoftheprosperityanddevelopmentoftrade,butatthesametime,manydisputesandemergenceofelectroniccontractsLegalissues.
Thisarticlesystematicallystudiesthelegalissuesrelatedtoelectroniccontractsininternationaltrade,analyzesthelegalissuesandeffectivenessoftheelectronicprocessofinternationaltradeelectroniccontracts,understandsthefactorsthatleadtotheriskofelectroniccontractsininternationaltrade,andhelpsenterprisessignelectroniccommerceThecontractprovidestheoreticalguidanceandsuggestionstoavoidpotentialrisks,sothatcompaniescancorrectlyandeffectivelyapplythiscontractforminforeigntradepractice,providingcompanieswithafeasiblewaytoattracttradingpartnersandprotecttheirowninterests.Therebyenhancingtheinternationalcompetitivenessofenterprisesandacceleratingthedevelopmentofnationaltrade.
