一、能否立案思考（各地法院做法不一）
根据最高人民法院《民事案件案由规定》(法发〔2008〕11号)的规定，夫妻婚内确认财产所有权之诉的案由应为“物权确认纠纷”。根据《物权法》的相关规定，对于所有权人不明的财产提起的物权确认之诉，是属于法定诉求之列。
但是，司法实践中对于该类诉讼的态度不统一。很多地方性法院对于夫妻婚内提起的财产所有权确认之诉均是不予立案，甚至认为是当事人亦或是律师“没事找事”。法院认为根据我国《婚姻法》第十七条规定：“夫妻在婚姻关系存续期间所得的房屋，应当归夫妻共同所有。即婚后夫妻一方所得财产，除法律另有规定或当事人另有约定外，均属夫妻共有。”因此，在婚姻关系存续期间取得的财产应划归夫妻共同财产，在共有基础不丧失的情况下，确定夫妻财产的所有权多此一举，属于司法资源的浪费；
即使受理后，司法实践中对是否支持确权也有两种不同意见：一种意见为不支持房屋确权，具体理由为：根据婚姻法的规定，婚后取得的财产为夫妻共同财产，既然法律已经明确规定，在没有第三人主张权利或不主张离婚的情况下，不支持婚内房产确权；另一种意见为支持房屋确权，具体理由为：《物权法》第19条“权利人、利害关系人认为不动产登记簿记载的事项错误的，可以申请更正登记…不动产登记簿记载的权利人不同意更正的，利害关系人可以申请异议登记。登记机构予以异议登记的，申请人在异议登记之日起十五日内不起诉，异议登记失效…”以及第33条“因物权的归属、内容发生争议的，利害关系人可以请求确认权利。”
